  • PREAMBLE
    We, the People of the City of Las Venturas, in order to form a more perfect municipal government, establish justice, ensure domestic tranquility, provide for public safety, promote the general welfare, and secure the blessings of liberty to ourselves and our posterity, do hereby ordain and establish this Charter as the supreme municipal law of the City of Las Venturas, subject only to the Constitution and laws of the higher sovereign authority.

    This Charter shall serve as the foundational legal instrument governing all municipal institutions, offices, powers, and procedures within the City of Las Venturas.


  • ARTICLE I — SOVEREIGN MUNICIPAL AUTHORITY
  • Section 1. Legal Status of the City
  1. The City of Las Venturas is hereby established as a municipal corporation possessing perpetual succession.
  2. The City shall exercise all powers of local self-governance not expressly prohibited by superior law.

  • Section 2. Source of Authority
    All municipal authority derives from:
  • This Charter
  • Enacted ordinances consistent with this Charter
  • Applicable state and federal law

  • Section 3. Supremacy Clause
    This Charter shall be the supreme municipal legal instrument. Any ordinance, regulation, or executive action inconsistent with this Charter shall be null and void to the extent of the inconsistency.


  • ARTICLE II — STRUCTURE OF MUNICIPAL GOVERNMENT
  • Section 1. Separation of Powers
    The government of the City of Las Venturas shall be divided into three (3) coequal branches:
  1. Executive Branch
  2. Legislative Branch
  3. Administrative Branches and Agencies
  • Each branch shall operate independently, subject to checks and balances established herein.

  • Section 2. Delegation of Authority
    No branch shall exercise powers properly belonging to another except as expressly authorized by this Charter.


  • ARTICLE III — EXECUTIVE AUTHORITY
  • Section 1. Office of the Mayor
  1. The Mayor shall serve as the Chief Executive Officer of the City.
  2. The Mayor shall ensure faithful execution of municipal law and administration.

  • Section 2. Executive Powers
    The Mayor shall have the authority to:
  • Enforce all municipal laws and ordinances
  • Appoint and remove department directors, subject to confirmation of the city council.
  • Issue executive directives consistent with law
  • Prepare and submit the annual fiscal budget
  • Represent the City in intergovernmental relations

  • Section 3. Limitations on Executive Power
    The Mayor shall not:
  • Enact laws unilaterally
  • Appropriate public funds without legislative approval
  • Suspend laws except as permitted under emergency powers

  • Section 4. Term of Office
    The Mayor shall serve a fixed term of three (3) months, subject to term limits and election laws established by ordinance.


  • ARTICLE IV — LEGISLATIVE AUTHORITY
  • Section 1. City Council
  1. Legislative authority shall be vested in the City Council.
  2. The Council shall be the sole body empowered to enact municipal law.

  • Section 2. Powers of the Council
    The Council shall have authority to:
  • Enact, amend, and repeal ordinances
  • Approve and modify the municipal budget
  • Conduct oversight of executive agencies
  • Confirm executive appointments where required
  • Establish municipal policy frameworks

  • Section 3. Composition and Structure
    The City Council shall consist of no fewer than four (4) appointed members, apportioned as defined by ordinance, led by the City Manager.

  • Section 4. Procedural Requirements
  • All legislative actions shall require a quorum.
  • Passage of ordinances shall require a majority vote unless otherwise specified.


  • ARTICLE V — MUNICIPAL ADMINISTRATION
  • Section 1. Executive Departments
    The City shall maintain administrative departments necessary for governance, including but not limited to:
  • Department of Public Works
  • Department of Transportation
  • City Manager's Office

  • Section 2. Authority of Departments
    Each department shall:
  • Execute and enforce municipal law within its jurisdiction
  • Operate under the supervision of the Mayor and the Council
  • Comply with Council-established policy directives

  • Section 3. Appointment of Directors
    Department Directors shall be appointed by the Mayor and confirmed by Council ordinance.


  • ARTICLE VI — PUBLIC SAFETY AND LAW ENFORCEMENT
  • Section 1. Las Venturas Metropolitan Police Department (LVMPD)
  • The Las Venturas Metropolitan Police Department ("LVMPD") is hereby established as the primary law enforcement agency of the City of Las Venturas and shall retain exclusive primary jurisdiction over all criminal law enforcement matters within City limits.
  • The LVMPD shall be responsible for the protection of life and property, enforcement of criminal statutes, prevention and investigation of crime, and maintenance of public order.
  • The LVMPD shall exercise full criminal investigative authority, including but not limited to violent crime, narcotics, organized crime, financial crime, cybercrime, and vice-related criminal activity.
  • The LVMPD shall maintain operational divisions as necessary for effective law enforcement, including patrol, investigations, vice/narcotics, SWAT, traffic enforcement, and forensic services.
  • The LVMPD shall retain authority for tactical operations, high-risk warrants, crisis response, and all criminal enforcement requiring armed intervention or investigative discretion.

  • Section 2. City Marshal Service
  • The Las Venturas City Marshal Service ("LV City Marshals") is hereby established as a sworn municipal enforcement agency operating under the authority of the City.
  • The LV City Marshals shall have strictly defined non-primary and administrative enforcement jurisdiction, limited to regulatory, civil, and specialized enforcement functions as set forth in this Charter.
  • The LV City Marshals shall be responsible for:
    • Business licensing, regulation, inspections, and administrative enforcement actions
    • Firearms licensing administration and regulatory compliance enforcement
    • Administrative investigations into licensed firearms violations
    • Force Investigation Section duties related to administrative review of use-of-force incidents
    • Security of City and State-owned buildings and facilities, including courts and City Hall
    • Dignitary protection and executive security services
    • Court bailiff duties and enforcement of courtroom order
    • Service and execution of court orders, warrants, and subpoenas in coordination with LVMPD where necessary
    • Enforcement of municipal codes and ordinances
    • Commercial vehicle enforcement and regulatory inspections
    • Secondary support law enforcement functions within City limits
  • The LV City Marshals shall not exercise primary criminal investigative authority or tactical policing powers and shall defer all criminal matters to LVMPD.

  • Section 3. Las Venturas Fire & Rescue Department (LVFR)
  • The Las Venturas Fire & Rescue Department ("LVFR") is hereby established as the primary emergency response agency of the City responsible for fire suppression, emergency medical services, technical rescue, and disaster response.
  • The LVFR shall be responsible for:
    • Fire suppression and fire prevention operations
    • Emergency medical response and pre-hospital care services
    • Technical rescue operations, including vehicle extrication, structural collapse rescue, and hazardous environments
    • Hazardous materials response and containment operations
    • Disaster response and emergency management support
    • Fire safety inspections and fire code compliance enforcement in coordination with applicable municipal authorities
  • The LVFR shall maintain operational divisions as necessary, including Fire Suppression, Emergency Medical Services, and Special Operations Rescue Units.
  • The LVFR shall have authority to coordinate with LVMPD and LV City Marshals during multi-agency emergency responses, but shall retain independent command over fire and medical operations.
  • The Fire Chief of LVFR shall be appointed by the Mayor, subject to confirmation where required by ordinance, and shall serve as the highest-ranking fire and rescue official in the City.

  • Section 4. Interagency Duties and Jurisdiction
  1. The LVMPD shall retain primary jurisdiction over criminal matters.
  2. The LV City Marshals shall retain primary jurisdiction over regulatory and administrative enforcement matters as defined herein.
  3. The LVFR shall retain primary jurisdiction over fire, rescue, hazardous response, and emergency medical operations.
  4. All agencies shall cooperate in multi-agency incidents while respecting jurisdictional boundaries established by this Charter.

  • Section 5. Accountability and Oversight
  1. All personnel within LVMPD, LV City Marshals, and LVFR shall be subject to internal disciplinary systems and administrative review.
  2. Civilian oversight mechanisms may be established by ordinance.
  3. No agency shall operate outside the bounds of this Charter or duly enacted municipal law.


  • ARTICLE VII — FINANCE, TAXATION, AND APPROPRIATIONS
  • Section 1. Fiscal Authority
    The City shall possess the authority to levy taxes, fees, and assessments as permitted by law.

  • Section 2. Budgetary Process
  1. The Mayor shall submit a proposed annual budget.
  2. The City Council shall review, amend, and approve the budget.
  3. No public funds shall be expended without legislative authorization.

  • Section 3. Financial Oversight
    Independent auditing procedures may be established to ensure fiscal accountability.


  • ARTICLE VIII — ELECTIONS AND DEMOCRATIC GOVERNANCE
  • Section 1. Electoral Principles
    All elections shall be conducted in a free, fair, and transparent manner.

  • Section 2. Eligibility
    Eligibility requirements for office shall be determined by law, consistent with equal protection principles.

  • Section 3. Administration of Elections
    An independent electoral authority may be established to oversee electoral integrity.


  • ARTICLE IX — ORDINANCES AND MUNICIPAL LAW
  • Section 1. Legislative Authority
    The City Council shall have exclusive authority to enact municipal ordinances.

  • Section 2. Hierarchy of Law
    Municipal ordinances shall be subordinate to this Charter and superior law.

  • Section 3. Enforcement
    Duly authorized municipal agencies shall enforce all laws.


  • ARTICLE X — AMENDMENT PROCESS
  • Section 1. Proposal of Amendments
    Amendments may be proposed by:
  • Majority of the City Council
  • The Mayor
  • Citizen initiative petitions as defined by ordinance

  • Section 2. Ratification
    Amendments shall require:
  • Supermajority approval of the City Council, and/or
  • Ratification by public referendum where required


  • ARTICLE XI — EMERGENCY POWERS
  • Section 1. Declaration of Emergency
    The Mayor may declare a state of emergency in response to natural disasters, civil unrest, or other threats to public safety.

  • Section 2. Scope of Emergency Powers
    During an emergency, the Mayor may issue temporary directives necessary to preserve public order, subject to Council review.

  • Section 3. Duration
    Emergency powers shall be limited in duration and subject to periodic review by the City Council.


  • ARTICLE XII — GENERAL PROVISIONS
  • Section 1. Severability
    If any provision of this Charter is held invalid, the remaining provisions shall remain in full force and effect.

  • Section 2. Interpretation
    This Charter shall be interpreted in a manner consistent with democratic governance, rule of law, and constitutional principles.

  • Section 3. Effective Date
    This Charter shall take effect upon adoption in accordance with applicable law.
